Does it matter what state I live in for filing bankruptcy?

Does it matter what state I live in for filing bankruptcy? I have floated between NY and PA for the last few years. Is it better to file in NY or PA over the other?

  1. This is a jurisdictional issue. A bankruptcy attorney would need to know the dates of residency for both states. Because you moved “back and forth” it is impossible to determine the length of stay in both states. Once your bankruptcy attorney determines which state’s exemptions apply, then you have to determine whether that state’s exemptions are adequate to protect your assets and whether that state allows federal exemptions which tend to be very generous and more “debtor friendly” then most state exemption laws. If you are seriously thinking bankruptcy then speak with experience bankruptcy lawyer.
