Does filing bankruptcy affect child support?

My wife and I will be begin our separation next month. I have considerable credit card and I’ll probably have to file for bankruptcy as I can’t pay it off. Will filing for bankruptcy affect the amount I have to legally pay for child support ?

  1. Child support is a non dis-chargeable debt under bankruptcy law. Whether filing for bankruptcy will affect the amount you must repay would better be discussed with your matrimonial attorney. I would be careful to file for bankruptcy without having that discussion first. The reason being if your disposable income increases because you no longer have the debt, then you child support could be affected. However, this may not have any effect but a note of caution.
