Any individual in the United States is eligible for Chapter 13 bankruptcy, as long as:
- their unsecured debts are less than $360,475, and
- their secured debts are less than $1,081,400.
These amounts adjust regularly to reflect the changes in the consumer price index.
You cannot file under Chapter 13 bankruptcy if:
- you are a corporation or partnership, or
- you have not received credit counseling from an approved credit counseling agency within 180 days prior to filing.
