Can I buy Christmas gifts and then claim bankruptcy?

I’m going to have to file for bankruptcy in the New Year. Does it matter if I use my credit card for Christmas gifts knowing that I won’t be able to pay it off? I’m sure many people do this so that they can still buy their kids gifts buy I want to make sure there won’t be any penalties or charges excluded.

  1. No bankruptcy attorney should tell you it’s ok to use your credit cards knowing that you are going to file bankruptcy. The credit card company can argue that any such charges are non-dischargeable in bankruptcy and further that your bankruptcy filing was in “bad faith”. It is much wiser and smarter to limit your potential exposure and not make any new credit charges.
