Behind on house payments after filing Chapter 13

It has been one thing after another and I am 2 months behind on my house payment. My mortgagee has written to the Chapter 13 Trustee requesting a Motion for Relief from Stay. Other than the obvious, somehow catching up my payments, do I have any shelter ffrom foreclosure?

One Response to “Behind on house payments after filing Chapter 13”

  1. Bankruptcy Expert says:

The short answer is no, you don’t really have many options. If you are behind on your mortgage payments, the court will not allow you indefinite protection under Chapter 13.

Your best options are to attempt to work out a catch-up plan with your mortgage holder. If that doesn’t work, your only other option will be to have your bankruptcy attorney attempt to defend the action in court.
