It has been one thing after another and I am 2 months behind on my house payment. My mortgagee has written to the Chapter 13 Trustee requesting a Motion for Relief from Stay. Other than the obvious, somehow catching up my payments, do I have any shelter ffrom foreclosure?
My home is scheduled to be foreclosed on very soon, I have attemtped to work the situtation out with my mortgage company. They have agreed to a repayment plan, however my new monthly mortgage payment will go from $1100 monthly to $1950 monthly. I cannot afford to pay that, but I can't lose my home. If I file Chapter 13 will this stop the foreclosure?

I recently read on the TSAC site that student loans which are a true hardship may be discharged in bankruptcy. Mine were high, $71,000 but made impossible by added charges for defaulting( I thought all were deferred while i was in grad school)I have a hugh wage garnishment and whopping balance of about $100,000 in student loans. TSAC wants $1000+ a month if I want to get away from a garnishment.They report this amount on my credit as my payment($1000+)when in fact it is about half that! (I have paid every month for 7 years but my credit is still screwed up! Credit Bureaus/FTC cannot/will not corect this!) That's more than half of my income. Could bankruptcy eliminate this debt? What can I do?

My Chapter 13 Bankruptcy will be finished Feb 2007. In my ltr from my attorney he said I would need a recordable order for my car in case I ever tried to sell it so that when they research the title itcomes up cleared. He wants to charge me $525.00 to do this adn if I wait until I would decide to sell it, it would be an additional $155.00 o re-open adn file it at that time. My question is this, can I do this adn thru whom, does it have to be by my attorney. It could be years before I decide to sell to sell it. Is this necessary?????? If I can do it myself, It would be better. Please advise.

I have just completed the first year of my 3-year Chapter 13 bankruptcy. I was told by an individual in the legal profession that because of my unique set of debt circumstances that I could petition the court to convert my Chapter 13 to a Chapter 7.
I am working and making my payments via employer payroll deduction and can continue without difficulty. However, if it is possible to get a "fresh start" by transferring to a Chapter 7, I would prefer to do so.
Although my vehicle was named in the bankruptcy, I am still making regular payments on it and my home.

My husband and I now have about $47,000 in Credit Card debt. We were ok before Hurricane Katrina and then over this past year have come across hardships. Currently we are not bringing in enough money to pay even our living expenses much less minimum payments. Not long after the hurricane I had a very bad pregnancy and was put on bed rest. I then had a pre term baby whom is home on a breathing monitor. The fact of the monitor prevents me from making the income I was making to meet our bills. My husband and I have tried everything to keep our head above water and we have now gotten to the point that we were late on two payments last month. We went to debt consolidation credit counseling and were told that we couldn't do that due to the lack of income. They told us to seek legal advice. I am still unable to work or find childcare at this time due to the monitor my child is on. We can't afford for the credit cards to continue to go unpaid. Where should we go from here?
If one has filed a Chapter 13 Wage Earner Plan and is already making payments with the Trustee will they be debt free at the end of the 5 years their lawyer stated. Will they be liable for any late payments, or in this instance a balloon payment was on a loan. The party was not delinquent on any bills when this was initiated. Loan payment bills are still being sent showing several thousand dollars in late fees and I don't understand why. This is the only creditor contacting the party with monthly statements. Payments are being made but the principle is not going down on the statement.
I have 4 major credit cards. After moving to another state I racked up $25000 of debt. My rates increased from 9%/11.99% to 29.99%. The credit company informed me they can increase my rates when they feel like it although I have never never made a late payment. Ive called three times to get a reduction...no luck. Should I file Chapter 7 bankruptcy??I cant keep paying $1000 a month to have it only apply to interest. The cards will never get paid off.I have been declined for a personal loan twice. I make about $6-$8 thousand a month but it barely covers my bills. What can I do??
I have no assets, only 43,000.00 in credit card debt. We are seniors with not a lot of time left, but need to take action on getting our debt cleared. We have used credit cards for moving expenses and medical. Basically we have nothing to lose. We want to pay our bills and have been talking with consumer credit counseling but we are not sure that is the way to go. What would be our best way? We have been using gift money from our 50th to sustain us.
