Individual Bankruptcy

Although I am married, I have a sole proprietorship. My debts are all business related. Can I file independently without interfering with my wife's or family's finances---things in her name or in both of our names, as opposed to the business debts?

1 Comments:

  • This is a complicated question. Yes, you can file bankruptcy independently (your wife is not required to also file since the debts are not in her name), but how the bankruptcy will impact on your business debts is a much more complicated question, and will depend on a number of factors.

We suggest you contact a bankruptcy attorney to fully explore your options, and determine how a bankruptcy will impact on your business debts.
