If you file for a Chapter 13 do you have to put your income tax return towards paying off your debt?

  • Under normal circumstances, if you are under Chapter 13 you will still receive your tax refund. Typically under Chapter 7 bankruptcy the Treasury Department will hold your tax refund until you are discharged. Your bankruptcy attorney can provide more details in your specific case.
