Chapter 7 Bankruptcy - Time Limit on Filing Again


I filed for Chapter 7 bankruptcy back in 1999 discharged in 2000. Now I have major medical debt due to traffic accidents w/o insurance. I resided in Florida when this happened now I reside in Indiana. How long before I can file again and in which State do I file?

  • As a general rule, if you filed and received a discharge in a prior Chapter 7 bankruptcy, you have to wait 8 years after the filing of the prior chapter 7 before you can file another chapter 7 case. It would therefore appear that you will need to wait at least two more years before you can file. Generally you file where you currently reside.
