Behind on house payments after filing Chapter 13

It has been one thing after another and I am 2 months behind on my house payment. My mortgagee has written to the Chapter 13 Trustee requesting a Motion for Relief from Stay. Other than the obvious, somehow catching up my payments, do I have any shelter ffrom foreclosure?

Foreclosure and Chapter 13

My home is scheduled to be foreclosed on very soon, I have attemtped to work the situtation out with my mortgage company. They have agreed to a repayment plan, however my new monthly mortgage payment will go from $1100 monthly to $1950 monthly. I cannot afford to pay that, but I can’t lose my home. If I file Chapter 13 will this stop the foreclosure?

I recently read on the TSAC site that student loans which are a true hardship may be discharged in bankruptcy. Mine were high, $71,000 but made impossible by added charges for defaulting( I thought all were deferred while i was in grad school)I have a hugh wage garnishment and whopping balance of about $100,000 in student loans. TSAC wants $1000+ a month if I want to get away from a garnishment.They report this amount on my credit as my payment($1000+)when in fact it is about half that! (I have paid every month for 7 years but my credit is still screwed up! Credit Bureaus/FTC cannot/will not corect this!) That’s more than half of my income. Could bankruptcy eliminate this debt? What can I do?

I am currently under the Chapter 13 Bankruptcy in NC…I pay my trustee monthly and maintain my mtg payments…If I sell my home currently owing 70K and wish to purchase another home what happens to the bankruptcy both with profit and also without a profit?
I am obligated for 3 yrs to the chapter 13 having filed in Feb of this year.

i filed a chapter 7 in july 2000 and was discharged in nov 2000 i filed a Chapter 13 august 2006 my payment is to high with our big house payment so we deeded the house back can i file a Chapter 7 ?
we filed the 13 to save our house but then our house payment went way up by $400 a month we cannot afford this

If you file for a Chapter 13 do you have to put your income tax return towards paying off your debt?

My questions is my husband fell ill and we have to convert to a chapter 7, I have my car that I had paid for before we were married it is the only vehicle we have left, can the court take the vehicle? even though it is the only one we have, I drive it to work and to take my spouse to his Doctor appts, this would leave us without any transportation at all. Is this allowed??

Builder Unable to Sell House

I was a builder, and finished my last house in January 2006. The asking price for the house is $449,000, and I have been unable to sell it. I am getting further and further in debt paying the interest charges to the bank. I do not own property, have a 2000 truck, and a few househould goods. What should I do?
