Chapter 7 bankruptcy and child support

my ex-husband has me listed as a creditor in his Chapter 7 bankruptcy . The only money he owes me is child support and medical expences that he has been court ordered to pay. Can he do this?

  • As a general rule, child support is not dischargeable in a Chapter 7 bankruptcy, so even if your ex husband has listed you as a creditor, he is still required to pay court ordered child support, whether he is bankrupt or not. Generally court ordered payments for medical expenses are treated the same way (the court considers them to be support as well).
