chapter 13 co-debtor

Please explain if co-debtors are also protected or how it affects them. What determines if they get a stay and if they do, can it later be lifted and why? Will co-debtor in a Chapter 13 have to file also? And if they don't file are they still responsible for the same debt?

  • In general, if you file under chapter 7 or chapter 13, only you are protected, not your co-borrower. Your co-borrower would also need to file to receive protection. This is a reasonably complicated area of law, so we suggest you contact a bankruptcy attorney for a detailed review of your situation.
