Bankruptcy and Lawsuits

Can someone who filed Chapter 7 bankruptcy, file lawsuits to sue someone else before their own case is decided ?

  • This is a question you should ask your attorney, since the exact answer will depend on the specifics of your case. However, in general, it is usually not advisable to commence a lawsuit until your Chapter 7 bankruptcy case is completed, because if you were to come into possession of assets while bankrupt it is possible that those assets could be seized as part of the bankruptcy process. Again, legal advice is required in your specific case.
