... and I'm feeling really scared and sad. I had no choice though - I couldn't keep up with the payments on a $45,000 credit card balance on a $41,000 salary. My lawyer seems really understanding and on top of of things.  Any advice to help with the scared/sad feelings? Cry

 ::)Look at the brighter side of this!  Banks have no compassion for you...so take your emotions out of the equation.  Lived thru BK....get yourself a clean slate....You'll be just fine

My husband and I have started the bankruptcy process.  We had a business fail a year and a half ago, and we are drowning in debt.  My anxiety keeps me up at night.  I pray a lot...  I would love to hear how others are keeping afloat during the process.

Chad, all I can say is your not alone, I feel the same way.  One good thing is that it seems you have a lawyer that at least keeps you informed, mine hasn't.  I get surprises from my lawyer, no answers.

Hi everyone,

I have not filed yet.  I own a house with my siblings.  My mother left it to us.  It complicates things because I don't want to cause them any problems.  If I file, I could be forced to sell.  They would be so mad it me.  I don't care about myself.  I'm just thinking of how they will feel if it comes to the  point of dragging them into it.

Danny you can file and get rid of just the credit cards. That's what I'm doing.
 You can keep the house. I am filing chapter 7 and I get to keep my house because I am only dismissing my cc.

top94 - I don't know what state you're in, but i'm in Illinois and am using Peter Francis Geraci. he's really good even if his commercials are a joke to watch. If you aren't in Illinois or Wisconsin, fire your attorney and get another one. No attorney should keep you in the dark like that.

From everyone else feeling bad, I felt that way before I filed, now I just feel  relief. all the debt that caused me so much stress and worry is gone. {{{{hugs}}}}

I just received my discharge papers yesterday or the day before.

I filed at the end of August 2011 and cashed in part of a 401K to pay the lawyers.  I asked him if he could lower the fee and he gave me a deal that if i paid him off in two months, he would take $200 off of the fee. I had him paid in a week and a half.

Aside from tons of paperwork, and one lawyer in the same office I didn't care for who I kept ended up with, The process was fairly painless.  The worst part was that I had to give up a credit card for a company that I loved and had for 19 years and wanted to continue paying, but they said I had to give them all up.

I was current on all of my bills up to the day I filed. That really killed me as I always paid my bills on time every month, but my losing my job 20 months ago meant robbing peter to pay paul and it got to a point where peter didn't have anything left to rob, so I had no choice but to file bankruptcy.  If I had gotten another job, I wouldn't have had to do this.

I still have my house since it's in both mine and my husband's names, but all my CC debt is gone ($68,000 worth) so that stress is gone. I still need a job though. *sigh*

BTW I used Peter Francis Geraci and their offices really know their stuff. The commercials are lame, but he's good.

It's also pissing me off that every day I get offers in the mail from some place that saw I was bankrupt and now wants me to buy a car with them.
